of Service
PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY
IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS
LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
Web Air Beds values you as a customer and your right to privacy. Except as may be otherwise required by law,
Web Air Beds will exercise commercially reasonable efforts to ensure that your personal information remains confidential and available only to
Web Air Beds, and its employees, agents, and contractors. Web Air Beds
will not sell your personal information to third parties.
Notwithstanding any statements on the web pages or these bullet points, the Terms and Conditions are the agreement between you and
Web Air Beds. By submitting each order at checkout, you confirm and agree to the Terms and
Conditions.
1. Offer and acceptance. By submitting a completed order form, you offer to purchase, on and pursuant to these Terms and Conditions and the order form, the
product you select and submit to Web Air Beds for purchase via the order form. Your offer may be accepted by
Web Air Beds by sending you an electronic confirmation that your order has been received and accepted. It shall be in
Web Air Beds discretion to accept or reject your order. If Web Air
Beds accepts your order, these Terms and Conditions and the order form collectively constitute a legal agreement between
Web Air Beds and you governing your purchase of the Product from Web
Air Beds over the online shopping service.
2. Responsibilities. If Web Air Beds accepts your order, Web Air Beds shall, in return for your payment, provide the Product which you ordered through the online shopping service. The Product shall be delivered to you at the delivery address you designate. Your payment for the Product and shipping, including sales taxes and assessments, is due upon completion of your order on-line.
Paypal will charge the payment to the credit card which you submit to
Web Air Beds, and will collect the payment from your bank. You authorize
Paypal to make and collect such charge. The total amounts you shall pay for the Product per each order shall be the sums of the respective prices for the items you select and submit via the order form, plus all applicable sales taxes and shipping charges, as reported to you as the "TOTAL" in the order form.
3. Communications. Web Air Beds shall conclusively presume that online communications received from you through your use of the online order form and
via email are accurate, complete, and authorized by you. You agree not to contest the validity and binding legal effect of those communications.
4. Returns. New product that you purchase directly from
Web Air Beds (and not a third party) you may return only in accordance
with Web Air Beds return policy in effect on the date of the invoice
or acknowledgement. You must contact us directly before you attempt to
return Product to obtain a Return Material Authorization Number for
you to include with your return. You must return Product to us in
their original or equivalent packaging. You are responsible for risk
of loss, shipping and handling fees for returning Product. Additional
fees may apply. Web Air Bed's return instructions can be found at: http://www.webairbeds.com/returninstructions.htm.
If you fail to follow the return instructions and policies provided by
Web Air Beds, Web Air Beds is not responsible whatsoever for Product
that is lost, damaged, modified or otherwise processed for disposal or
resale. If you are returning all components in an order, you will be
credited the full amount paid for the order less the original shipping
fees according the stated policy/instructions. At Web Air Beds discretion,
credit for partial returns or damaged product may be less than the
original sale price and are subject to current replacement pricing.
All sales are final on foundations, custom made mattresses, and sale
items.
No returns will be authorized for foundations, custom made mattresses,
air chambers or air pumps that are sold outside of a bed system, and sale items.
5. Web Air Beds right to refuse service. Web Air Beds in its sole
discretion reserves the right to refuse service to anyone with or
without cause or reason.
